OF THE CITY COUNCIL OF THE
CITY OF CUDAHY
AMENDING MUNICIPAL
CODE WITH TH RESPECT
TO THE OVAL OF
GRAFFITI.

THE CITY COUNCIL OF
THE CITY OF CUDAHY DOES ORDAIN AS FOLLOWS:
SECTION 1: Subsection
9‑5.15 is hereby added to the Cudahy Municipal Code to read as follows:
"Subsection 9‑5.15.
GRAFFITI REMOVAL. Notwithstanding any other provision of the Cudahy Municipal
Code to the contrary, whenever the City Manager determines that graffiti or
other inscribed material is so located on public or private property as to be
obnoxious and capable of being viewed by a person utilizing any public right‑of‑way
in this City, be this road, parkway, alley or otherwise, and the owner of the
property consents to the removal by the City of the graffiti or other inscribed
material and executes such document as the City may provide relative to the
removal of the graffiti or‑other inscribed material, then the City
Manager is authorized to provide for the removal of the graffiti or other
inscribed material. If the City Manager provides for the removal of the
graffiti or other inscribed material, he shall not authorize nor undertake to
provide for the painting or repair of any more extensive area than that where
the graffiti or other inscribed material is located."
SECTION 2: This
Ordinance shall take effect thirty (30) days after its passage, and prior to
the expiration of fifteen (15) days from the passage, the City Clerk shall
cause it to be posted in at least three (3) public places in the City as set
forth in the Cudahy Municipal Code.

ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUDAHY AMENDING THE CUDAHY
MUNICIPAL CODE WITH RESPECT TO THE SALE AND POSSESSION OF AEROSOL SPRAY PAINT
AND DYES.
THE
CITY COUNCIL OF THE CITY OF CUDAHY HEREBY ORDAINS AS FOLLOWS:
Section
1. Chapter 6 of the Cudahy Municipal
Code is hereby amended to add Subsection 6-50 which shall read as follows:
“AEROSOL
SPRAY PAINT AND DYE. SALE,
DISTRIBUTION, AND POSSESSION.”
(a)
Regulation
of the Sale and Distribution of Aerosol Spray Paint and Dyes. No person shall sell, exchange, give or
loan, or cause or permit to be sold, exchanged, given or loaned, any
pressurized can containing any substance commonly known as paint or dye to
anyone under the age of eighteen (18) years, unless such person be the parent
or legal guardian of said minor. No
person under the age of eighteen (18) years of age shall purchase any
pressurized can containing paint or dye.
(b)
Display. Any person who maintains a place of business
shall store and display any pressurized cans containing any substance commonly
known as paint or dye in a locked cabinet or display case, behind a counter, or
in a separate room or enclosure not accessible to minors.
(c)
Possession
- - Public Recreation Areas. No person
shall have in his possession any pressurized can containing any substance commonly known as paint or dye
while in any park, playground, swimming pool, or recreation facility (other
than a highway, street, alley or way) except authorized employees of the City,
or an individual or company under contract with the City.
(d)
Possession
- - Streets and Other Public Places. No
person under the age of eighteen (18) years of age shall have in his possession
any pressurized can containing any substance commonly known as paint or dye
while on any public highway, street, alley or way, or other public place,
whether such person is or is not in any automobile, vehicle, or other
conveyance.
(e)
Any
violation of this Subsection shall be deemed to be an infraction.
Section
2. This Ordinance shall take effect thirty (30 )
days after its final passage, and prior to the expiration of fifteen days from
the passage, the city Clerk shall cause it to be posted in at least three (3)
public places in the City as set forth in the Municipal Code.
