ORDINANCE NO. 685
AN ORDINANCE OF THE CITY OF CERRITOS PROVIDING FOR THE
REMOVAL OF GRAFFITI OR OTHER INSCRIBED MATERIALS FROM PUBLIC OR PRIVATELY OWNED
STRUCTURES LOCATED ON PUBLIC OR PRIVATELY OWNED REAL PROPERTY AND
AMENDING THE CERRITOS MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF CERRITOS DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1. Chapter
9.62 is hereby added to Title 9 of the Cerritos Municipal Code to read as
follows:
Chapter 9.62
Graffiti
9.62.10 Finding that Graffiti or other Inscribed Material is Obnoxious. The Cerritos City Council does hereby find that graffiti or other inscribed material is obnoxious, be it on public or private property.
9.62.20
Graffiti Removal. Consent of
Property Owner; Removal by Director of Public Services.
Notwithstanding any other provision of the Cerritos Municipal Code to the
contrary, whenever the Director of Public Services determines that graffiti or
other inscribed material is obnoxious and is so located on public or private
property as to be capable of being viewed by a person utilizing any public right
of way in this City, be this road parkway, alley, or otherwise, and the owner of
the property consents to the removal by the City of the graffiti or other
inscribed material and executes such document as the City may provide relative
to the removal of the graffiti or other inscribed material, then the Director of
Public Services is authorized to provide for removal of the graffiti or other
inscribed material. If the Director
of Public Services provides for the removal of the graffiti or other inscribed
material, he shall not authorize
nor undertake to provide for the painting or repair of any more extensive area
than that where the graffiti or other inscribed material is located.
SECTION 2. This ordinance shall take effect thirty (30) days after its final passage and within fifteen (15) days after its passage, the City Clerk shall cause it to be posted in three (3) public places designated for that purpose.
